This website is operated by Lollipops and Lace. Throughout the website, the terms “we”, “us” and “our” refer to Lollipops and Lace.

By visiting our website, purchasing a product, placing an order or using any part of our website, you agree to be bound by these Terms of Service. Please read these terms carefully before using our website or placing an order.

These Terms of Service apply to all website visitors, customers and purchasers of Lollipops and Lace products and services.

Nothing in these Terms of Service is intended to exclude, restrict or modify any rights or remedies available under the Australian Consumer Law.

Products and Services

Lollipops and Lace offers products and services that may include:

• Custom cakes, cupcakes, cookies and cake pops
• Edible images and edible printed products
• Acrylic cake and cupcake toppers
• Cookie cutters
• Embossers and debossers
• 3D-printed baking tools, organisers and accessories
• Seasonal products
• Custom and personalised products
• Digital products or downloadable files, where available

Products may be added, changed, updated or discontinued at any time without notice.

We make every effort to display product colours, designs, sizes and images as accurately as possible. However, colours may appear differently depending on lighting, screen settings, printing processes and material batches.

As many of our products are handmade, custom-made or 3D printed, minor variations may occur. These variations are part of the handmade or manufacturing process and are not necessarily considered faults.

Orders

By placing an order, you confirm that:

• The information you have provided is complete and accurate
• You have reviewed all names, dates, wording, colours, sizes, quantities and personalisation details
• You are authorised to use the payment method provided
• You agree to these Terms of Service and our other applicable policies

An order is not considered confirmed until payment has been received and the order has been accepted by Lollipops and Lace.

We reserve the right to decline or cancel an order where necessary, including where a product is unavailable, incorrect information has been supplied, a pricing error has occurred or we are unable to fulfil the requested order.

If we cancel an order after payment has been received, any applicable refund will be issued using the original payment method.

Custom and Personalised Orders

Customers are responsible for checking all information supplied for custom or personalised products.

This includes:

• Names
• Spelling
• Dates
• Ages
• Wording
• Colours
• Sizes
• Quantities
• Images
• Logos
• Design instructions

Lollipops and Lace is not responsible for errors contained in information supplied or approved by the customer.

Changes may not be possible once designing, printing, baking, cutting, engraving, manufacturing or production has commenced. Additional fees may apply where changes require extra design work, materials or production time.

Where a design proof is provided, it is the customer’s responsibility to carefully review and approve the proof. Production may commence following approval.

Customer-Supplied Images, Logos and Designs

By providing an image, logo, photograph, character, artwork, wording or other material, you confirm that you have permission or the appropriate rights to use and reproduce that material.

You agree that Lollipops and Lace may use the supplied material solely as reasonably required to create and fulfil your order.

We reserve the right to decline requests that we reasonably believe may infringe another person’s intellectual-property rights or that contain unlawful, offensive or inappropriate material.

Pricing and Payment

All prices are displayed in Australian dollars unless otherwise stated.

Prices may change at any time without notice. Any price change will not affect an order that has already been accepted and paid for unless an obvious pricing or technical error has occurred.

Payment must be made using one of the payment methods available at checkout or otherwise agreed upon.

Orders may not enter production until the required payment or deposit has been received.

Any delivery, postage, customisation or additional service fees will be displayed at checkout or included in your quote where applicable.

Quotes and Deposits

Quotes are valid for the period stated on the quote. If no expiry period is provided, pricing and availability may be subject to change before payment is received.

An order date is not secured until the required deposit or full payment has been received.

Deposits may be non-refundable once design work, ingredients, materials, custom supplies or production have been arranged or commenced, except where otherwise required by Australian Consumer Law.

Any remaining balance must be paid by the due date provided. Failure to make payment may result in the order being delayed or cancelled.

Cancellations and Changes

Please contact us as soon as possible if you need to cancel or change an order.

Changes or cancellations may not be available once design work, purchasing, printing, baking, manufacturing or production has commenced.

Where a cancellation is approved, reasonable costs already incurred may be deducted from any refund, including design time, ingredients, materials, custom supplies and work already completed.

Cancellation rights and remedies will continue to apply where required under Australian Consumer Law.

Collection and Delivery

Customers are responsible for providing accurate collection, delivery and contact information.

Collection times must be arranged and followed. If a customer is delayed, they should contact Lollipops and Lace as soon as possible.

Where delivery is available, estimated delivery times are provided as a guide and may be affected by circumstances outside our reasonable control.

We are not responsible for delays caused by postal services, couriers, incorrect addresses or circumstances outside our reasonable control. This does not limit any rights available under Australian Consumer Law.

Customers should inspect their order as soon as reasonably possible after collection or delivery and contact us promptly if there is an issue.

Cakes and Edible Products

Once cakes, cupcakes, cookies, cake pops or other edible products have been collected or delivered, the customer is responsible for their safe handling, storage and transportation.

Customers should follow any storage, handling or serving instructions provided.

Lollipops and Lace is not responsible for damage caused after collection or delivery by:

• Incorrect storage
• Heat or direct sunlight
• Leaving products in a vehicle
• Uneven or unstable surfaces
• Sudden braking or unsafe transportation
• Mishandling by the customer or another person
• Failure to follow supplied care instructions

Customers are responsible for informing us of any allergies or dietary requirements before placing an order.

While reasonable care may be taken, products may be prepared in an environment where common allergens are handled. Unless expressly confirmed in writing, we cannot guarantee that products are completely free from traces of allergens.

Edible Images

The quality and appearance of edible images may vary slightly depending on the original image quality, colours, printing process and edible printing materials.

Customers are responsible for supplying clear, high-quality images wherever possible.

Minor colour differences between the original digital image and the printed edible product are not considered faults.

Edible images should be stored and applied according to the care instructions provided.

3D-Printed Products

3D-printed products may display minor layer lines, texture variations or small cosmetic differences as a normal result of the 3D-printing process.

These characteristics do not generally affect the intended function of the product and are not necessarily considered defects.

Customers must follow all care and use instructions provided. Unless specifically stated otherwise:

• Do not place 3D-printed products in a dishwasher
• Do not expose products to high temperatures
• Do not place products in an oven or microwave
• Do not leave products in direct sunlight or a hot vehicle
• Hand wash gently using cool or lukewarm water

Damage caused by excessive heat, incorrect cleaning, misuse, excessive force or failure to follow care instructions may not be considered a product fault.

Product Safety and Intended Use

Products must only be used for their intended purpose and in accordance with any instructions supplied.

Some products may contain small parts or sharp edges and may not be suitable for children. Adult supervision is required where appropriate.

Cake toppers, acrylic decorations, 3D-printed decorations and other non-edible components must be removed before serving or consuming food.

Returns, Refunds and Faulty Products

Returns, exchanges, cancellations and refunds are managed in accordance with our Returns and Refund Policy and Australian Consumer Law.

Custom-made, personalised and edible products may not be eligible for a change-of-mind return.

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law.

Digital Products

Where digital products or downloadable files are offered, customers receive a limited licence for the use described in the applicable product listing.

Unless expressly stated otherwise, digital files may not be:

• Resold
• Shared
• Redistributed
• Uploaded to file-sharing websites
• Copied and sold as digital files
• Claimed as the purchaser’s own design

Any permitted commercial use will be stated in the relevant product description or licence terms.

Due to the immediate-access nature of digital products, change-of-mind refunds may not be available once a file has been accessed or downloaded, except where required by law.

Intellectual Property

Unless otherwise stated, all website content and original Lollipops and Lace materials—including branding, logos, photographs, product images, written content, original designs and digital files—remain the property of Lollipops and Lace.

Content may not be copied, reproduced, modified, distributed, sold or used for commercial purposes without prior written permission.

Product Photography and Social Media

We may photograph completed products and share those images on our website, social-media pages, portfolio or promotional materials.

We will take reasonable care not to publish personal customer information without permission.

If you would prefer your custom order not to be photographed or shared, please contact us before collection, delivery or publication.

Website Use

You agree not to use this website:

• To upload malicious software or harmful code

• To submit false or misleading information
